Tort of Get Refusal

CWJ's founder, Susan Weiss, initiated the innovative practice of suing recalcitrant husbands for damages (torts). One of the CWJ's goals is to file as many claims for get abuse that it can across the country. We want to make it an established legal certaintly that get refusal is no longer a religious right but a civil wrong. 

Most claims for damages for get abuse are withdrawn in exchange for the get. The following cases were decided:

#1 Jer. Fam Ct. 2001: There is a Cause of Action in tort for Get Refusal (Judge B.Z. Greenberger)
