Minow explores the paradox of observing differences with gender and race in the American judicial system. If the differences are acknowledged, they risk being perpetuated, but if they are not acknowledged, status quo may keep these differences entrenched in systematic discrimination. Her arguments importantly support the conceptual work of CWJ.
